There are immediately two cases pending against you when you have been arrested or cited for a DWI/DUI in Louisiana. The first case, which occurs shortly after the arrest, is pending with the Louisiana Department of Public Safety, Motor Vehicles Division, and deals with your driving privileges. The second case pending against you is dealing with the criminal charge(s), and will be handled by the City Prosecutor or District Attorney based on the location and jurisdiction of arrest.
The Louisiana Department of Public Safety, Motor Vehicles Division, will attempt to impose a suspension of your driving privileges based on the “Refusal/Submit” to the chemical test. The length of this suspension, and the specific requirements for a hardship license and reinstatement, are based on (1) whether you “Refused” or “Submitted” to the chemical test; (2) and if “Submitted” to the chemical test, the specific Blood Alcohol Content(“BAC”) registered as the result of the test.
