There are immediately two cases pending against you when you have been arrested or cited for a DWI/DUI in Louisiana. The first case, which occurs shortly after the arrest, is pending with the Louisiana Department of Public Safety, Motor Vehicles Division, and deals with your driving privileges. The second case pending against you is dealing with the criminal charge(s), and will be handled by the City Prosecutor or District Attorney based on the location and jurisdiction of arrest.
The Louisiana Department of Public Safety, Motor Vehicles Division, will attempt to impose a suspension of your driving privileges based on the “Refusal/Submit” to the chemical test. The length of this suspension, and the specific requirements for a hardship license and reinstatement, are based on (1) whether you “Refused” or “Submitted” to the chemical test; (2) and if “Submitted” to the chemical test, the specific Blood Alcohol Content(“BAC”) registered as the result of the test.
By law, you are given one opportunity to challenge or contest the pending license revocation by submitting a request for an Administrative Hearing within Thirty(30) days of the arrest. If you fail to submit the request for hearing within the time allowed by law, you WILL automatically lose your driving privileges. Due to recent changes in the law, there is a common misconception regarding automatically losing your driving privileges for one(1) year if you “Refuse” to submit to the chemical test. However, you are still provided with the same opportunity to request an Administrative Hearing to challenge the pending license revocation.
James Caruso has been successful in the Administrative proceedings obtaining “Recall” decisions for his clients which cancels the pending license suspension, and he has the skills needed to provide the solid defense you deserve.
